JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-01-2019 The petitioner apprehends his arrest in connection with Konch P.S.Case No. 51 of 2018 registered under Sections 147, 148, 149, 307, 323, 324, 326, 341, 504 and 506 of the Indian penal Code.
Allegation as per the FIR is that while the children of the villagers were playing cricket, due to damage of crops, scuffle took place and the petitioner and other accused persons variously armed came and it is alleged that petitioner assaulted by means of sword to Gyan Chand Das causing injury to him. Submission of learned counsel for the petitioner is that there is dispute with respect to playing of cricket and there was no such intention to kill anyone.

Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.77779 of 2018(2) dt.02-01-2019 2/2 circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-III, Gaya in connection with Konch P.S. Case No. 51 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sujit/- U T
