Petitioner seeks bail in Chandauti P.S. Case No.08 of 2017 instituted for the offence under Section(s) 302, 120-B/34 Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that Petitioner is in custody since 11.08.2018 having clean antecedents. There is no recovery of any incriminating article from his possession. During course of investigation, location of mobile of deceased was found near Chandauti Police Station. It is alleged that some talk took place between deceased and this petitioner on mobile. Besides suspicion, there is no allegation against the petitioner.

In the facts and circumstances of the case, prayer of

Patna High Court Cr.Misc. No.77468 of 2018(2) dt.15-01-2019 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Chandauti P.S. Case No.08 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
