2. The petitioner seeks bail in connection with Begusarai Muffasil P.S. Case No. 458 of 2023 registered for the offence punishable under Section 392 of the Indian Penal Code.

3. As per the prosecution case, one motorcycle and Rs. 10,000/- has been looted by unknown criminals.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case merely on suspicion.

5. The petitioner's name has come during investigation. The petitioner has not been put on Test Identification Parade and there is no recovery from the

Patna High Court CR. MISC. No.2004 of 2024(2) dt.18-01-2024 2/2 possession of the petitioner. The petitioner is in jail since 11.08.2023 having clean antecedent.

6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

7. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai in connection with Begusarai Muffasil P.S. Case No. 458 of 2023.

8. The petitioner will also mark attendance in Ballia Police Station, Begusarai on the first and third Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U T
