JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2019 This application, for grant of anticipatory bail, arises out of Wazirganj P.S. Case No. 206/2019, disclosing offences under Sections 341, 323, 308, 379, 504 and 34 of the Indian Penal Code.

Allegation against the petitioner is of assault to one Lalti Devi by means of Farsa and impugned order shows that injury sustained by her was found grievous in nature. Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been made accused in this case and further there is case and counter case between the parties.

Learned A.P.P. opposed the prayer for anticipatory bail.

Having heard both sides, considering the facts and

No.80293 of 2019(2) dt.10-12-2019 2/2 circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner has to surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.

This application is, accordingly, dismissed.
