JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 This application, for grant of anticipatory bail, arises out of Doriganj P.S. Case No. 152/18, disclosing offences under Sections 363, 365 366(A), 376/34 of the Indian Penal Code. Allegation against petitioner no. 1 is that he kidnapped the minor daughter of the informant and other petitioners happen to be family members of petitioner no.1. Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and the statement of girl recorded under Section 164 Cr.P.C. clearly
Patna High Court Cr.Misc. No.2190 of 2019(2) dt.16-01-2019 2/2 shows that she went with the petitioner no. 1 out of her own sweet will and performed marriage with him and want to live with him and she has disclosed her age as 22 years. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM -VII, Saran at Chapra, in connection with Doriganj P.S.
