The petitioner apprehends his arrest in connection with Chainpur P.S. Case No. 31 of 2019 registered for offence punishable under sections 363, 366(A) of the Indian Penal Code.

The allegation against the petitioner is that he enticed away the minor daughter of the informant Triveni Noniya. Although, the victim Minta Kumari, in her statement recorded under section 164 Cr. PC, has stated that the petitioner after administering some intoxicant, took away her Hapur

Later on, an affidavit has been filed by the victim Minta Kumari, which is annexed with the record, which shows that the Minta Kumari has solemnized marriage with the petitioner and she is residing with him. Paragraph no. 89 of the case diary contains the statement of Rajmati Devi, who is mother of the victim, Minta Kumari. The mother of the victim has stated that her daughter Minta Kumari is residing with the present petitioner after solemnizing her marriage in Delhi. The mother of the victim has also stated that his daughter has a female child of one year.

Considering the above mentioned facts and circumstances, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Kaimur at Bhabua in connection with Chainpur P.S. Case No. 31 of 2019, subject to condition as laid down under section 438(2) Cr. P.C. (Nawneet Kumar Pandey , J) Mahesh/- U T
