2. The petitioner seeks bail in connection with Patna City Chowk P.S. Case No. 397 of 2021 registered for the offence under Section 302 and 201/34 of the Indian Penal Code.

3. As per the prosecution case, one Bablu was shot in his mouth by Chunnu Chaudhary, Praduman Kumar @ Chipra and Pintu Kumar and he died.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case and one co-accused namely Praduman Kumar @ Chipra has been granted bail by this Court vide order dated 04.02.2023 passed in Cr. Misc. No. 32434 of 2022.

5. It is also submitted by the learned counsel for the petitioner that the petitioner has clean antecedents and he is in jail since 31.08.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts, period of custody and also considering the fact that other co-accused persons have been granted by this Court, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II, Patna City in connection with Patna City Chowk P.S. Case No. 397 of 2021, G.R. No. 3996/21, S.T. No. 481/22.

9. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Patna City Chowk Police Station on first and third Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U T
