The petitioner seeks bail in Piprahi P. S. Case No. 82/18 instituted for the offence under Section(s) 307, 353,395,414,216(A) of the Indian Penal Code and Sections 25(1-b)a, 26, 27, 35 of the Arms Act and Sections 3 and 4 of the Explosive Substance Act and Sections 30(a), 47 of Bihar Prohibition and Excise Act,2016.

It is alleged in the written report that police got information that few people have assembled for committing crime. Thereafter, police went to the place of occurrence and apprehended one Scorpio vehicle with six persons sitting therein. Police recovered one pistol, one mobile phone of Samsung company and one mobile phone of Nokia company

Patna High Court Cr.Misc. No.77284 of 2018(2) dt.21-12-2018 2/2 and three bottle of Royal Stage each containing 180ml, from the vehicle.

It has been submitted that there is no recovery of any incriminating article from conscious possession of this petitioner. It has further been submitted that other co-accused who were also found sitting on the vehicle has already been granted bail by this Hon'ble Court vide order dated 17.12.018 passed in Cr. Misc. no. 75038 of 2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge cum Special Judge 2nd, Sheohar, in connection with Piprahi P. S. Case No. 82/18 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
