The petitioner has prayed for bail in connection with Ganga Bridge P.S. Case No. 177 of 2019 registered for the offence punishable under sections 356 and 379 of the Indian Penal Code.
As per allegation in the FIR, a mobile phone of the informant was stolen which according to the seizure list has been recovered from the petitioner.
It is submitted by learned counsel for the petitioner that incriminating articles have not been recovered from the possession of the petitioner. It is further submitted that there is overwriting in the time as stated in the body of the FIR. It is further submitted that there is overwriting also in the name of
Patna High Court CR. MISC. No.80072 of 2019(2) dt.05-12-2019 2/2 the petitioner in seizure list and that the petitioner who has no criminal antecedent is in custody since 17.10.2019. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Ganga Bridge P.S.
