Petitioner seeks bail in Chainpur P.S. Case No.196 of 2018 (G.R. No.1949 of 2018) registered for the offence punishable under Sections 304 (B) and 34 of the Indian Penal Code.
Informant who is the father of the deceased has alleged that husband (petitioner) along with his family members killed his daughter due to non-fulfillment of demand of dowry. It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case due to enmity. The deceased had committed suicide and this fact also gets corroborated from the post mortem report which has been annexed as Annexure-2. During investigation independent witness and co-villagers have stated that deceased committed
Patna High Court Cr.Misc. No.78655 of 2018(3) dt.30-01-2019 2/2 suicide. Similarly, situated co-accused persons have been granted bail by co-ordinate benches of this Court vide orders dated 11.12.2018 in Criminal Miscellaneous No. 61614 of 2018 and 07.12.2018 in Criminal Miscellaneous No. 70190 of 2018. Petitioner has got no criminal antecedent and is in custody since 13.09.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Kaimur at Bhabua in connection with Chainpur P.S. Case No.196 of 2018 (G.R. No.1949 of 2018), with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be cancelled by the court below.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (S. Kumar, J) ranjan/- U
