The petitioner seeks bail in connection with Special Case No.7280 of 2019 arising out of Digha P.S. Case No.473 of 2019 registered under Section 30 (a) of the Bihar Prohibition and Excise Amendment Act, 2016.

It is contended that the petitioner is a tempo driver. He was not aware of the contents of the bag of the passenger, who was also apprehended by the police while sitting in his tempo and from whose bag 52 liters India made foreign liquor was recovered. It is further contended that the petitioner is the only earning member of the family and he is in custody since 16.08.2019 without any fault of his own.
