2. The petitioners seek bail in a case registered for offence under Sections 103, 3(5) of the Indian Penal Code.

3. As per prosecution case, the informant came to know by some villagers that F.I.R. named accused persons including these petitioners committed murder of her husband by mixing some poison in his wine.

4. Learned counsel for the petitioners submits that as per F.I.R. itself, informant is not eye-witness to the occurrence and she has not disclosed as to who disclosed about involvement of petitioners and others in the alleged incident. As a matter of fact, husband of informant consumed some spurious

Patna High Court CR. MISC. No.84765 of 2025(2) dt.04-12-2025 2/2 liquor and due to that reason, he died. Petitioners have got no concern with the alleged occurrence and are in custody since 30.08.2025, having no criminal antecedent. Chargesheet has been submitted.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Yogapatti P.S. Case No. 268 of 2024.
