JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 22.10.2018 in connection with Complaint Case no. 5444© 2017 in which after due inquiry prima facie case for the offences punishable under Sections 379, 454 and 493 of the Indian Penal Code was found.
The accusation against the petitioner is that he established physical relation with complainant on the basis of false promise of marriage and also took her ornaments and cash. Submission on behalf of the petitioner is that even if, prosecution story assumed to be true, then also, contents of the complainant petition go to show that the complainant was a

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Complainant Case No. 5444( C) P.S. Case No. 2017.
