JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2019 Petitioner seeks bail in connection with Saharsa Rail P.S. Case No. 25 of 2019, registered for the offence punishable under Section 395 of Indian Penal Code. As per F.I.R., some miscreats looted mobile and money from the passenger at the Railway Station on the point of arms. F.I.R. was lodged against unknown, later on name of petitioner transpired during the investigation on the confessional statement of Sachin Kumar and he was seen talking with the stolen mobile.
Submission of learned counsel for the petitioner is that except confessional statement, there is no recovery from the possession of the petitioner and petitioner is in custody for about three months and he has not put for T.I.P, and charge sheet has already been submitted.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Railway Judicial Magistrate, Khagaria, in connection with Saharsa Rail P.S. Case NO. 25 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned. Further condition is that he has to appear before the police station of his local area in the first week of every month so that the police may watch his conduct.
Let a copy of this order be communicated to the S.P. Khagaria for needful.
