The petitioner has prayed for bail in connection with Sultanganj P.S. Case No. 192 of 2019 registered for the offence punishable under section 414 of the Indian Penal Code. As per allegation in the FIR, stolen motorcycle is said to have been recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating material as alleged has been recovered from the person or possession of the petitioner. The petitioner is in custody since 05.08.2019 and the offence alleged is trialable by the Magistrate.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the

Patna High Court CR. MISC. No.80069 of 2019(2) dt.05-12-2019 2/2 case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Bhagalpur in connection with Sultanganj P.S.
