ANJANA MISHRA ORAL ORDER 13-02-2020 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner seeks appropriate writ, order or direction to the respondent-authorities, namely, the District Level Security Committee, Muzaffarpur (Respondent No.7) and the District Magistrate, Muzaffarpur (Respondent No.8) to take appropriate steps for providing security to the life and property

Patna High Court CR. WJC No.13 of 2020(3) dt.13-02-2020 2/3 of the petitioner and his family members who are existing under the life threat created by Respondent No.10, who claims to be a local politician with high level political connections. Learned counsel for the petitioner submits that earlier also the petitioner had come to this Court in Cr.W.J.C. No.362 of 2019 for the similar relief. The said writ application was disposed of on 13.02.2019 with liberty to the petitioner to approach the District Level Security Committee for redressal of his grievances. Learned counsel further submits that thereafter the petitioner has filed a representation before the District Level Security Committee on 28.02.

2019, which was duly received in the office, but till date no order has been passed thereon, resulting in further anxiety and mental anguish to the petitioner and he continues to exist under the threat and intimidation of the Respondent No.10. It is thus prayed that the District Level Security Committee (Respondent No.7) and the District Magistrate, Muzaffarpur (Respondent No.8) may be directed to take appropriate action in the matter, so that the security and life of the petitioner is not jeopardized any further at the hands of the local politicians and aggressive people.

Having considered the entire facts and circumstances of the case and in view of the fact that the representation dated

WJC No.13 of 2020(3) dt.13-02-2020 3/3 28.02.2019 is still pending, it is directed that the District Magistrate, Muzaffarpur (Respondent No.8) shall take up the matter within a period of three weeks from the date of receipt/production of a copy of this order and after making necessary inquiries at the local level, shall pass appropriate order, in accordance with law. In case it is found that the petitioner is, in fact, still under the security threat, the concerned respondents shall take necessary steps in the matter. The entire exercise in this regard should be completed by the 20th of March, 2020.

The application stands disposed of.
