====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-01-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 336(2), 338, 340(2), 316(2), 318(4) of the Bharatiya Nyaya Sanhita.

3. It is alleged that on the basis of forged and fabricated documents, petitioner obtained the tender for door-todoor cleaning from Municipal Council, Rajgir.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He next submits that enquiry was conducted behind the back without giving any notice to the petitioner. Petitioner is a contractor and he is involved in the business of taking Government contracts. He further submits that in the entire F.I.R., there is no allegation

Patna High Court CR. MISC. No.88894 of 2024(2) dt.20-01-2025 2/2 of misappropriation or embezzlement of Government fund and character certificate has been issued to the petitioner by Superintendent of Police, Begusarai to the said effect on 6.4.2023.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rajgir P. S. Case No. 332 of 2024, subject to condition as laid down under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) Navya/- U T
