JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 Petitioners apprehend their arrest in connection with Ramnagar P.S. Case No. 285 of 2018 registered for the offences punishable under Sections 147, 148, 149, 34, 341, 323, 324, 307 and 379 of the Indian Penal Code.

Allegation against petitioner No.2 is of assault to the informant, causing injury and petitioner No.1 is named in the FIR.

Submission of learned counsel for the petitioners is that there is case and counter case between the parties and there is delay in lodging the present case and no specific allegation of assault has been attributed against petitioner No.1 and injuries are found to be simple in nature, which will appear from Annexure-3.

Having heard both sides and in the facts and circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Bagaha, District West Champaran, in connection with Ramnagar P.S. Case No. 285 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
