The petitioners apprehend their arrest in Chenari P.S. case No. 233/2019 registered under Section 323, 341, 307, 504, 506, 379, 34 of the IPC.

The informant alleged that on 03.10.2019 some altercation took place near goddess Durga idol. When the informant asked the petitioners not to play D.J. the petitioners

Patna High Court CR. MISC. No.79481 of 2019(5) dt.30-06-2020 2/2 assaulted the informant and her family members with lethal weapon.

The learned counsel for the petitioners submits that the petitioners are innocent and in fact they have committed no offence. The petitioners are residents of the same village. There was a free fight between two sides. The petitioner No.1 has also filed Complaint case No. 1011/2019 but it appears from the record and case diary that the petitioners are alleged to have assaulted the informant and others with lethal weapon. The informant also got injury on her head and she was advised for C.T. scan. Many persons got injuries on their vital party of the body.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
