2. This application has been filed for modification of the order dated 12.09.2025 passed in Cr. Misc. No. 40778 of 2025 whereby this Court was pleased to grant anticipatory bail to the petitioner with a direction that he shall pay the alleged defalcated amount amounting to Rs. 9,00,000/- (Rupees nine lacs) out of which Rs. 1,00,000/- (Rupees one lakh) shall be deposited at the time of furnishing bail bond and rest of the amount shall be deposited in 12 equal installments amounting to Rs. 8,00,000/- (Rupees eight lacs) within a period of twelve
2/4 months from the date of furnishing bail-bond in the Nazarat of the learned trial court.

The present modification application has been filed on the ground that out of the alleged defalcated amount amounting to Rs. 9,00,000/- (Rupees nine lacs), in terms of direction of this Hon'ble Court dated 08.08.2025 passed in Cr. Misc. No. 27120 of 2025, co-accused Dilip Kumar has already deposited Rs. 3,78,000/- (Rupees three lacs seventy eight thousand) in the Nazarat of Civil Court, East Champaran, Motihari and out of the rest amount of Rs. 5,22,000/- (Rupees five lacs twenty two thousand), petitioner has already deposited Rs. 2,34,000/- (Rupees two lacs thirty four thousand) in the Nazarat of the learned trial court and as such, petitioner is only required to deposit Rs. 2,88,000/- (Rupees two lacs eighty eight thousand) more, which he is ready to deposit. Accordingly, learned counsel for the petitioner requests for necessary correction in the order.
4. In view of reasons assigned in the petition and aforesaid submission of learned counsel appearing on behalf of the petitioner, let Paragraph No. 5 of the order dated 12.09.2025 passed in Cr. Misc. No. 40778 of 2025 be read as follows:- "5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. petitioner,
3/4 mentioned above, is directed to be enlarged on provisional bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Motihari, East Champaran in connection with Motihari (Cyber) Police Station Case No. 43/2024 on following conditions:- (i) At the time of furnishing bail bond, Rs. 1,00,000/- shall be deposited by the petitioner in the Nazarat of the Court below and its receipt shall be submitted at the time of filing bail bonds. (ii) Rest amount of Rs. 4,22,000/- shall be deposited by the petitioner in 12 equal installments in 12 months thereafter.
(iii) If the petitioner complies with these conditions, his provisional bail shall be confirmed, and if he fails to comply with the conditions, court below shall be at liberty to cancel the bail bonds of the petitioner."
5. It is made clean that since petitioner has already deposited Rs. 2,34,000/- (Rupees two lacs thirty four thousand), he is only required to deposit Rs. 2,88,000/- (Rupees two lacs eighty eight thousand) more in equal installments.
6. With the aforesaid directions, order dated 12.09.2025 passed in Cr. Misc. No. 40778 of 2025 is modified to
