2. The petitioner seeks bail in connection with Simari P.S. Case No. 123 of 2013 registered for the offence punishable under Sections 363/366(A)/34 of the Indian Penal Code.
3. As per the prosecution case, on 13.06.2013, when the minor daughter of the informant had gone to attend the call of nature, his co-villagers namely Arjun Singh, his helper Rahul Singh, Tuntun Singh, Vivek Singh kidnapped her daughter with ulterior motive.

Learned counsel for the petitioner submits that the petitioner has been made accused only because he happens to be the father of the co-accused Arjun Singh who is alleged to have taken the daughter of the informant as they are in love with each other. The son of the petitioner along with the informant's
Patna High Court CR. MISC. No.89683 of 2024(6) dt.06-08-2025 2/3 daughter are still traceless. The petitioner has no knowledge about their whereabouts.
5. A report was called for from the Superintendent of Police, Buxar, with regard to the steps taken by the police for recovery of the informant's daughter.

The Superintendent of Police, Buxar submitted a report vide letter dated 27.06.2025 stating therein that all steps were taken including the scientific steps for recovery of the victim girl but the girl is not traceable. The proceeding under Section 82 and 83 of the Cr.P.C. has also been initiated against the absconder in this matter.
7. On the other hand, learned Additional Public Prosecutor appearing on behalf of the State submits that the F.I.R. was registered in the year 2013 and the petitioner was absconding for which proceeding under Section 82 was initiated against the petitioner.
8. Anticipatory bail application of the petitioner was rejected by this Court vide order dated 23.04.2014 passed in Cr. Misc. No. 40511 of 2013. The petitioner was arrested in Excise case and was remanded in this case. The petitioner is in custody since 09.10.2024.
9. Regards being had to the submissions made by the

No.89683 of 2024(6) dt.06-08-2025 3/3 parties and taking into consideration the nature of allegations and the fact that the petitioner is father of the co-accused Arjun Singh who is also missing with the girl of the informant and the petitioner is in custody since 09.10.2024 and chargesheet has been submitted, I am inclined to grant bail to this petitioner.
10. Accordingly, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar/ concerned court in connection with Simri P.S. Case No. 123 of 2013.
11. The petitioner is directed to appear on each and every date fixed by the trial court and in case he fails to do so on two consecutive dates, his bail bonds are liable to be cancelled. (Anil Kumar Sinha, J) Saif/- U T
