2. The petitioner has prayed for bail in connection with Bheldi P.S. Case No. 35 of 2025 registered for the offence punishable under Sections 308(2) and 308(5) of the B.NS.
3. The case of the prosecution is that a call was received on mobile number of the informant from mobile no. 8235372756 and the caller disclosed himself as Saurabh Kumar and demanded Rs. 5,00,000/-as extortion money, failing which the informant will have to face dire consequences.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. During course of investigation, one Prince Kumar has given his confessional
Patna High Court CR. MISC. No.84872 of 2025(2) dt.15-12-2025 2/2 statement and name of this petitioner has surfaced on the basis of confessional statement of the co-accused Prince Kumar. He is not concerned in any way with the alleged mobile number. It has also been submitted that two similarly situated co-accused persons, namely, Adarsh Kumar and Mukesh Kumar have been granted bail by this Court vide Cr. Misc. No. 83687 of 2025 and 59469 of 2025 respectively. The case of this petitioner stands on similar footing. Petitioner is languishing in judicial custody since 02.08.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Saran at Chapra in connection with Bheldi P.S. Case No. 35 of 2025.
