Petitioner is in custody in connection with Excise Case No. 1104 of 2018 arising out of Ara Town P.S. Case No. 386 of 2018 for the offence under section 30(a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent.

He submits that petitioner is neither owner of the vehicle nor owner of the liquor. He is not concerned with trade of liquor. He submits that in similar case owner of the vehicle has been granted bail.

Considering the fact that the petitioner is in custody since 11.7.2018 having no criminal antecedent, let the petitioner,

Patna High Court Cr.Misc. No.2822 of 2019(2) dt.22-01-2019 2/2 named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Bhojpur at Ara, in connection with Excise Case No. 1104 of 2018 arising out of Ara Town P.S.
