Heard learned counsel for the parties concerned. 2.

The present petition has been filed for modification of the order dated 07.11.2023, passed by this Court in Cr. Misc. no. 71277 of 2023.

Learned counsel for the petitioner submits that vide aforesaid order, the petitioner was directed to surrender before the learned court of Special Judge, Excise Court no. 1, Aurangabad, within a period of four weeks from the date of order but due to mis-communication, he could not surrender within time and furnish bail bonds.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also taking into account the averments made

Patna High Court CR. MISC. No.10450 of 2024(2) dt.09-02-2024 2/2 in the present petition, order dated 07.11.2023, passed in Cr. Misc. no. 71277 of 2023 is modified and now, the petitioner is directed to surrender before the learned court of Special Judge, Excise Court no. 1, Aurangabad, within a period of two weeks from today, subject to deposit of a sum of Rs. 2,000/- before the District Legal Services Authority, Aurangabad. 5.

The present petition stands allowed with the aforesaid modifications.
