2. The petitioner is apprehending his arrest in connection with Manihari P.S. Case No. 187 of 2025, F.I.R. dated 14.07.2025 for the offences punishable under Sections 74 and 76 of the BNS.
3. According to prosecution case, when the informant went to the market along with her daughter, the petitioner put his hand on the breast of the informant. On this, the informant caught his hand and directed her daughter to call the police. In the meantime, when the police officials came the petitioner fled away with the help of other accused persons.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has been falsely implicated in the present case. The allegation as alleged is false and fabricated and the petitioner has not committed any offence as in the F.I.R. In fact the marriage of the daughter was performed with the brother-in-law of the petitioner and due to some dispute arose between the daughter of the informant and brother-in-law of the petitioner, the petitioner has falsely been implicated in this case.
5. Learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that it appears from the F.I.R. that the serious allegation is levelled against the petitioner.

Considering the aforesaid facts and circumstances that petitioner has clean antecedent and due to some family dispute, the petitioner has falsely been implicated in this case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Katihar in connection with Manihari P.S. Case No. 187

No.86686 of 2025(2) dt.08-01-2026 3/3 of 2025, subject to the conditions as laid down under Section 482(2) of the Code of Criminal Procedure and with other following conditions:- i. Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below. ii. If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
iii. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
