The petitioner is languishing in custody since 27.09.2018 in a case registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code. The prosecution case as per the written report of Suyra Prasad Yadav, Block Education Officer, Kiratpur submitted to the Station House Officer of Jamalpur Police Station is to the effect that the petitioner, being the Headmaster of Middle School, Bhaluaha misappropriated Rs.Ten lakhs sanctioned for construction of residential training centre in the premises of Middle School, Bhaluaha by the Bihar Education Project, Bihar.

It is submitted by learned counsel for the petitioner

Patna High Court Cr.Misc. No.4741 of 2019(2) dt.29-01-2019 2/2 that the petitioner has completed the work by spending more than sanctioned amount for the construction of residential training centre. However, the petitioner retired on 31.01.2015 when the FIR was registered on 08.05.2015. It is further submitted that the investigation has already been concluded. Learned APP submits that the petitioner has misappropriated the government money.

Considering the fact that the investigation has already been concluded and the petitioner has retired, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Biraul, Darbhanga in connection with Jamalpur P.S. Case No. 49 of 2015.
