JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bibhutipur P.S. Case No. 105 of 2019, corresponding to G.R. No. 644 of 2019, registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

As per FIR there is recovery of huge quantity of liquor from pickup van of the petitioner.

Submission of learned counsel for the petitioner is that pickup van was being used on hire basis and he was not present and he has no role in carrying of liquor, having no criminal antecedent.

Heard learned APP also, who has opposed the prayer for anticipatory bail of the petitioner.

Patna High Court CR. MISC. No.83907 of 2019(2) dt.18-12-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He has to surrender and pray for regular bail. This application is dismissed.
