1. Heard the parties.

2. The petitioners apprehend their arrest in connection with Patna Excise P.S. Case No. 1841 of 2025 dated 26.09.2025 registered under Section 30(a) / 56(b) / 32(3) / 41 and 62 of the Bihar Prohibition and Excise Amendment Act, 2022.

3. As per the first information report a total quantity of 912.960 liters of Indian make foreign liquor has been recovered from a godown near Mina Sadan situated at Chhoti Pahari and from a pick- up vehicle standing in front of the gate of the godown.

4. Learned counsel for the petitioners submits that petitioners

Patna High Court CR. MISC. No.84552 of 2025(2) dt.17-12-2025 2/3 are innocent and have falsely been implicated in this case inasmuch as they have not committed any offence in the manner alleged. The name of the petitioners transpired in this case on the basis of disclosure made by the apprehended accused persons Prince Kumar and Dheeraj Kumar. The petitioners are neither the owner nor the driver of the seized vehicle in question. The petitioner no. 1 has one criminal antecedent in a case registered under Section 356 / 379 / 34 of the I.P.C. and the petitioner no. 2 has also one criminal antecedent related to Excise Act.

Regard being had to the submission made by the parties, taking into consideration the fact that name of the petitioners has transpired in the disclosure made by the arrested co-accused and the petitioners are neither the owner nor the driver of the pick- up vehicle, accordingly , I am inclined to grant anticipatory bail to the petitioners.

6. Let the petitioners be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (Excise) 3rd , Patna in connection with Patna Excise P.S.
