JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-12-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Sasaram Nagar (Darigaon) P.S. Case No. 835 of 2019 for the offence under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that the petitioner was not named in the F.I.R. and his name surfaced in the confessional statement of co-accused Raja Khan. He also submits that the petitioner is in custody since 22.09.2019, yet he has not been put on Test Identification Parade.

Considering the fact that the petitioner has got no criminal antecedent and he has not been put on T.I.P. despite the fact that he is in custody since 22.09.2019, the petitioner, named
