Petitioner is in custody in connection with S.T. No. 211 of 2018, arising out of Pirpainti P.S. Case No. 308/2017 for the offence under sections 302, 201/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent.
Int the instant case FIR was lodged against the three suspects. The name of the petitioner surfaced in the instant case on the suspicion that he is lover of Kanchan Devi, a suspect in the commission of crime.
Learned counsel for the petitioner submits that similarly circumstanced Kanchan Devi has been granted bail by
Patna High Court Cr.Misc. No.79711 of 2018(2) dt.15-01-2019 2/2 a coordinate bench of this court in Cr. Misc. No. 61524 of 2018 vide order dated 1.11.2018.
Considering the fact that petitioner was not suspected by the informant at the time of lodging of the Fard-beyan and his name was subsequently surfaced in the case as he was lover of the Kanchan Devi who has been granted bail by a coordinate bench of this court and also considering the fact that petitioner has no criminal antecedent and he is in custody since 30.10.2017, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge-1, Bhagalpur, in connection with S.T. No. 211 of 2018, arising out of Pirpainti P.S. Case No. 308 of 2017.
