2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 272, 273, 328, 308, 304, 120(b)/34 of the Indian Penal Code and Sections 30(a), 37(B), 33, 34 of the Bihar Prohibition and Excise Act.
3. As per prosecution case, 380 litres illicit liquor was recovered from the shop of co-accused persons.
4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner and his name transpired during course of investigation on the basis of confessional statement of co-accused. Petitioner has got no criminal antecedent of similar nature.
5. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.89180 of 2024(2) dt.02-04-2025 2/2 of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned court of 3rd Exclusive Special Excise, Saran at Chapra in connection with Maker P. S. Case No. 08 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
