JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2019 This is an application for grant of anticipatory bail in connection with Kanti P.S. Case No. 639 of 2018, disclosing offences under Sections 30(a), 41 of the Bihar Prohibition and Excise Act.

Allegation against the petitioner and other co-accused person is of recovery of 561 liters liquor from his house. Submission of learned counsel for the petitioner is that he was not present there at that time and nothing has been recovered from his conscious possession. Further, he has no criminal antecedents.

Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances of the case, I am not inclined to grant anticipatory

Patna High Court Cr.Misc. No.1692 of 2019(2) dt.24-01-2019 2/2 bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court. Accordingly, this application is dismissed.
