The petitioners apprehend their arrest in connection with Jamo Bazar P.S. Case No. 120 of 2019 for the offence punishable under Sections 307, 379 and other allied sections of the Indian Penal Code.

The allegation is regarding the accused persons including the petitioners herein having assaulted the informant and snatched a sum of Rs. 5,000/-.

The learned counsel for the petitioners submits that a bare perusal of the fardbeyan of the informant would show that the allegation of assaulting the informant is upon the co-accused

Patna High Court CR. MISC. No.80384 of 2019(2) dt.06-12-2019 2/2 persons, namely, Amit Kumar Singh and Ranjeet Kumar Singh and as far as the petitioners are concerned, there is no allegation of any sort of overt act on their part. It is further submitted that the petitioners are having a fair antecedent, except one complaint case which is said to be pending against them in which they are on bail.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioners above named are directed to be released on anticipatory bail on furnishing bail- bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- XIIIth, Siwan in connection with Jamo Bazar P.S. Case No. 120 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) Tiwary/- U T
