2. The petitioner seeks regular bail in connection with Uphara P.S. Case No. 96 of 2024 registered for the offence under Sections 87 of the Bharatiya Nyaya Sanhita, 2023. Subsequently, Sections 8 and 12 were added.

3. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 30.8.2024

4. Learned counsel for the informant has vehemently opposed the prayer for bail and has submitted that out of four charge-sheeted witnesses, three witnesses have been examined.

5. Though the allegation against the petitioner is of kidnapping the victim girl but from the statement of the victim girl, it appears that she had eloped with the petitioner on her own.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below, Aurangabad in connection with Uphara P.S. Case No. 96 of 2024 subject to condition that:- (i). The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and noncooperation in the trial shall result in cancellation of the bail bonds of the petitioner.
