The petitioner seeks anticipatory bail in connection with Hajipur Nagar P.S.Case No. 550 of 2018, registered for offences punishable under Sections 467, 468, 379 and 420/34 of the Indian Penal Code..

As per F.I.R., allegation against the petitioner is that the petitioner has withdrawn Rs. 47,000/- from the account of the informant by putting his forged signature as the informant had lost the passbook and it is alleged that withdrawal has been done with the connivance of the Bank staff.

Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and during investigation, report from Bank was called for but that does not show that the cheque that on which basis the alleged money was withdrawn, contained forged signature of the informant. It is further submitted that the petitioner has no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Hajipur Nagar P.S.Case No. 550 of 2018, to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
