2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 394 of the Indian Penal Code.
3. As per allegation in the FIR, three miscreants came to the Gumti where informant was working as gate-man, on pistol point they snatched his mobile, and three hundred rupees from his pocket. On protest made by the informant, accused persons assaulted him on his head and blood started oozing thereafter they locked the informant inside the gumati and fled away.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Neither
Patna High Court CR. MISC. No.964 of 2024(2) dt.16-01-2024 2/2 the petitioner is named in the FIR nor put on TIP. He has been implicated in this case on the basis of confessional statement of apprehended co-accused Sudhakar Kumar. There is no eye witness of the alleged occurrence. Nothing has been recovered from his conscious possession. Petitioner is languishing in judicial custody since 1.3.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Khagaria in connection with Mansi P.S. Case No. 26 of 2023. (Sunil Kumar Panwar, J) sushma/- U
