JUSTICE RAJESH KUMAR VERMA ORAL ORDER 30-03-2026 Heard Mr.Avinash Kumar Pandey, learned counsel for the petitioner and Mr.Aditya Narayan Singh.1, learned Additional Public Prosecutor for the State.
2. The petitioner seeks bail, who is in custody since 27.08.2024 in connection with Parsa P.S. Case No. 348 of 2023, F.I.R. dated 20.10.2023 registered for the offence punishable under Sections 302/34 of IPC.
3. As per FIR, allegation against the petitioner is that he alongwith other accused persons of this case surrounded the son of informant and killed him by knife and rod and crushed his head by assaulting with brick.
4. Learned counsel for the petitioner submits that the allegation as alleged in the FIR is false and fabricated and the

Further submits that from a bare perusal of the FIR it appears that there is no specific allegation of any assault or overt-act attributed against the petitioner rather there is general and omnibus allegation against all the accused persons including the petitioner.

Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner and submits that the confessional statement of co-accused person, namely, Shambhu Manjhi @ Rawan was recorded in paragraph-19 of the case diary in which he has stated that the petitioner has assaulted to the deceased by means of iron rod and co-accused person, namely, Ravi Girio has assaulted to the deceased by means of knife and the same was supported by the medical evidence (postmortem report), apart from the aforesaid, the cloth which was used at the time of occurrence, was recovered from the house of co-accused person, namely, Shambhu Manjhi @ Rawan.
6. Considering the aforesaid facts, confessional statement of co-accused person which is supported by the medical evidence as well as the recovery, I am not inclined to enlarge the petitioner on bail in connection with Parsa P.S. Case
