2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 8, 22 and 23 of the NDPS Act.
3. The case of the prosecution in short is that altogether 12.99 gram of brown sugar and nepali rupees worth 6620/- along with golden chain and a gold like ring and a motorcycle were recovered.
4. Learned counsel for the petitioner has submitted that nothing has been recovered from the possession of the petitioner rather the petitioner has falsely been implicated in this case. Learned counsel for the petitioner has submitted that police has not followed Section 105 of the BNSS while making
Patna High Court CR. MISC. No.84927 of 2025(2) dt.15-12-2025 2/2 recovery. It has also been submitted that the contraband as alleged is though more than small quantity but is much less than the commercial quantity. Learned counsel for the petitioner has submitted that the petitioner is a man of clean antecedent and is in judicial custody since 11.08.2025.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Raxaul P.S. Case No. 349 of 2025, NDPS G.R. Case No. 111 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, East Champaran, Motihari.
