2. The petitioner apprehends arrest in connection with Complaint Case No. 873 of 2024 instituted under Sections 352, 115(2), 126(2) and 85 of the Bharatiya Nyaya Sanhita.
3. The parties have settled the dispute and have
Patna High Court CR. MISC. No.84564 of 2025(4) dt.27-02-2026 2/3 entered into an agreement. Pursuant to that, a cheque of Rs. 3,00,000/-is being handed over to the learned counsel for the opposite party no. 2. The same is accepted by learned counsel for the opposite party no. 2.
4. If the cheque is not honoured and bounces because of insufficient funds, then the petitioner shall be dealt by this Court by passing appropriate orders.
5. In view of the agreement between the parties, this application is allowed.
6. Let the petitioner, above named, in the event of arrest or surrender before the Court below within six weeks from today, be released on provisional anticipatory bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sasaram, Rohtas/ concerned Court in connection with Complaint Case No. 873 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
7. The provisional anticipatory bail of the petitioner shall be confirmed by the Court below after, pursuant to the agreement, the entire amount is paid.
8. In case the petitioner fails to make the entire
Patna High Court CR. MISC. No.84564 of 2025(4) dt.27-02-2026 3/3 payment as per the agreement, then the bail bonds of the petitioner shall be cancelled. Further, in case, the cheque(s) of the petitioner bounces then also the bail bonds of the petitioner shall be cancelled.
