JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 17-07-2019 This application under Articles 226 and 227 of the Constitution of India has been filed by the petitioner for directing the respondent authorities to release the Mahindra Scorpio S2 white coloured bearing registration no.BR-11Y 3157, Engine No.TDG4E80136 which has illegally been seized in connection with Ratanpur P.S. Case No.65 of 2018 dated 10.11.2018 registered inter alia under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.
Realizing that the confiscation is a civil proceeding, learned counsel for the petitioner seeks leave to withdraw the
Patna High Court CR. WJC No.3404 of 2018(2) dt.17-07-2019 2/2 present writ petition with liberty to the petitioner to file a civil writ application for release of Mahindra Scorpio S2 white coloured bearing registration no.BR-11Y 3157, Engine No.TDG4E80136 seized in connection with Ratanpur P.S. Case No.65 of 2018 dated 10.11.2018.
Leave is granted.
