2. The petitioner seeks bail in connection with Kharik P.S. Case No. 189 of 2023 registered for the offence under Section 341, 324, 307, 504, 506/34 of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioner is of assaulting the victim with a Spade (Kudal).

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case as the parties are agnates and there is a pending land dispute between the parties.

5. It is also submitted by the learned counsel for the petitioner that the petitioner has no criminal antecedent and he is in jail since 20.08.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts and the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Naugachia, Bhagalpur in connection with Kharik P.S. Case No. 189 of 2023.
