====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 28-02-2025 Heard learned Counsel for the petitioner as well as learned APP for the State.

2. In this case, the petitioner is seeking regular bail in connection with Kamtaul P.S. Case No. 66 of 2024 registered for the offences punishable under Sections 399, 402, 413 and 414 of the Indian Penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act.

3. As per allegation, on the tip off, the informant along with the police personnel reached at the place of occurrence. On seeing the police party, the accused persons started to flee away but the police on chase, apprehended five accused persons including the petitioner. On search, the police recovered one country-made pistol, two live cartridges were recovered from possession of the petitioner.

4. The learned counsel for the petitioner has submitted that the prayer for bail of the petitioner rejected vide order dated 04.07.2024 in Cr. Misc. No. 46167 of 2024 but fresh ground for

Patna High Court CR. MISC. No.89833 of 2024(2) dt.28-02-2025 2/2 renewal for bail petition is that on similar footing some coaccused persons have been granted bail by the co-ordinate bench in Cr. Misc. No. 7285 of 2025, Cr. Misc. No. 58891 of 2024 and Cr. Misc. No. 61165 of 2024. Learned counsel has submitted that the case of the petitioner is on exactly similar footing than those who have been granted bail by the coordinate bench.

5. On the other hand, the learned APP for the State opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned J.M.-1st Class, Darbhanga in connection with Kamtaul P.S. Case No. 66 of 2024, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
