The petitioner seeks bail in a case instituted for the offences under Sections 25(1-b)a, 25(1)a, 26 and 35 of the Arms Act.

Prosecution case, in short, is that one double barrel gun was recovered from the accused persons.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.7.2019 and has got no criminal antecedent. Charge-sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner was employed as guard in the Bank. When the licence of the gun was asked from the petitioner, the petitioner has produced photo copy of the licence

Patna High Court CR. MISC. No.79428 of 2019(2) dt.04-12-2019 2/2 of the arms. There is no compliance of Section 100 Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rohit Kumar, C.J.M., Purnea in connection with K. Hat (Sahayak) P.S. Case No. 531 of 2019.
