The petitioner seeks bail in Kumarkhand P.S. Case No. 232 of 2017, instituted for the offence under Section(s) 392/34 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is not named in the written report. No Test Identification Parade has been held. There is no recovery from possession of the petitioner. The name of petitioner has come in the confessional statement of co-accused Murtaja.
Petitioner is in custody since 19.4.2018.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.79181 of 2018(2) dt.23-01-2019 2/2 bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Madhepura, in connection with Kumarkhand P.S. Case No. 232 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
