2. The petitioners apprehend their arrest in connection with Patarghat P.S. Case No. 68 of 2025 dated 08.06.2025, registered for the offences punishable under Sections 126(2), 115(2), 118(1), 117(2), 109, 76, 303(2), 308(2), 351(2), 352(2), 3(5), 189(2), 191(2), 191(3) and 190 of the B.N.S., 2023.

3. The allegation against the petitioners is of causing assault to the informant and his family members by means of

Patna High Court CR. MISC. No.85268 of 2025(2) dt.24-12-2025 2/3 deadly weapons along with other accused persons besides the allegation of snatching of valuables and threatening them.

Learned Advocate appearing on behalf of the petitioners taking this Court through the FIR contended that the FIR has been instituted against twenty-three named accused persons including the petitioners, however, no specific accusation has been levelled against the petitioners. So far the specific accusation is concerned, the same has been levelled against Bilas Beldar and Kundan Kumar who are not before this Court. It is further contended that though Md. Mujim has sustained grievous injury, but certainly the same has not been attributed to any of these petitioners. The reason behind the said occurrence is nothing but a land dispute as is evident from the pendency of Title Suit No. 599 of 2024. With respect to the alleged incidence, the persons of the petitioners' side have also instituted Patarghat P.S. Case No. 67 of 2025, which is on earlier point of time. The petitioners are man of clear antecedent and they undertake that they will fully cooperate in the proceeding of the Court.

5. On the other hand, learned Advocate for the State vehemently opposed the pre-arrest bail application and submits that the petitioners have also actively participated in the crime resulting into serious injuries to two of the persons.

6. Regard being had to the submissions advanced by

No.85268 of 2025(2) dt.24-12-2025 3/3 the learned Advocates for the respective parties and taking note of the nature of the accusation against the petitioners, coupled with the factum of case and counter case besides the fair antecedent of the petitioners, let the petitioners, above-named, be released on bail, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt / production of a copy of this order, upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Patarghat P.S. Case No. 68 of 2025, subject to the conditions laid down in Section 482(2) of the B.N.S.S., 2023, with the further condition that one of the bailors shall be the own / close family members of the petitioner.
