2. The petitioner seeks regular bail in connection with Ramkrishna Nagar Town P.S. Case No. 566 of 2023, lodged on 09.09.2023 under Sections 8/20(b)(ii)(B) of the N.D.P.S Act.

3. As per the prosecution case, the FIR has been lodged against the sole petitioner who was alleged to fled away from the place of occurrence, but police has recovered ganja of total 1.2 kg. from the gumti which alleged to be belongs to the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the said recovered quantity of ganja is above the small quantity, but much below than the commercial

5. Learned APP for the State vehemently opposes the prayer for bail of the petitioner and submits that the antecedent of the petitioner is not clean and he has been accused in earlier case also which is related to N.D.P.S.

6. In the present facts and circumstances, this Court is not inclined to grant regular bail to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner in connection with Ramkrishna Nagar Town P.S. Case No. 566 of 2023, pending before the learned Sessions Judge/Special Judge, (N.D.P.S.), Patna is hereby rejected.

8. Liberty is hereby granted to the petitioner that he may renew his prayer for bail six months after framing of charge.
