The petitioner has filed the instant application for grant of anticipatory bail apprehending his arrest in a case registered for the offence under sections 147, 148, 149, 341, 323, 307, 384, 385, 386, 427, 504 and 506 of the Indian Penal Code and Section 30(c) of the Indian Forest Act. As per allegation in the F.I.R., six named accused persons including the petitioner herein along with 100 other persons armed with lathi etc. cut down 53 trees in the land of the informant. On the informant reaching his agricultural land and on protesting, it is stated that the accused persons threatened to assault and to shoot him. It is further stated that the accused persons asked him to sell the land or they would forcibly take the land somehow.
It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.79332 of 2019(2) dt.19-02-2020 2/2 that the allegations in the F.I.R. are general and omnibus in nature and the case of the petitioner stands on the similar footing that of the accused namely Ajay Kumar Sinha @ Chhotu who has been enlarged on bail vide order dated 23.01.2020 passed in Cr. Misc. No.4456 of 2020.
The application for bail has been opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the above stated facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The petitioner, above named, in the event of his arrest or surrender in the Court below within a period of six weeks from today in connection with Jalalgarh P.S. Case No.128 of 2019 is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea, subject to the conditions as laid down in section 438(2) of the Criminal Procedure Code.
