The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 342, 323, 354(B), 384, 427, 504, 506, 376/511 and 120(B)/34 of the Indian Penal Code.

Though the informant has alleged that the petitioner and others committed sexual assault. However, later on she filed an affidavit that due to dispute arising out of payment of charges of dance programme, the case was lodged and she had not named the petitioner and other accused but the police found the petitioner's name figured during the course of investigation. Considering the affidavit of the informant, let the above named petitioner be released on anticipatory bail in the

No.79081 of 2019(2) dt.04-12-2019 2/2 event of his arrest or surrender in the court below within a period of thirty days from the date of receipt of the order, on furnishing bail bond of Rs.20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Bodh Gaya P.S.Case No.434 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
