JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner apprehends his arrest in connection with Bhagwanpur P.S. Case No.115 of 2019 registered under Sections 341, 356, 382, 376 and 511/34 of the Indian Penal Code.

The accusation is that the informant along with her brother Vikram Kumar was going to the house of her maternal aunt to give the marriage invitation card. In the way, four persons started scuffling with them and snatched the mobile, Mangal-Sutra, cash Rs.2000/- etc. of the informant. They also tried to take the informant towards the Railway Quarter. On 'hullah', all fled away from there. The informant claimed that

Learned counsel for the petitioner submits that the petitioner is the co-villager of the maternal aunt of the informant and there is dispute in between the maternal aunt of the informant and the petitioner, due to that reason, the petitioner has falsely been implicated in this case. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Vaishali at Hajipur, in connection with Bhagwanpur P.S. Case No.115 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
