2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
3. The petitioner is apprehending her arrest in a case in connection with Hilsa P.S. Case No. 223 of 2023 dated 18.04.2023 registered for the offence/s punishable under Section 366 (A) of the Indian Penal Code.
4. The co-accused person, Suraj Kumar is alleged to have kidnapped the minor daughter of the informant by enticing her at the instigation of the petitioner and the co-accused person.
5. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. It is further submitted that the petitioner has been made accused in
Patna High Court CR. MISC. No.3394 of 2024(2) dt.05-02-2024 2/2 the present case because she is the sister of the co-accused Suraj Kumar. The petitioner has no criminal antecedent. He further submits that victim has love affair with the co-accused and she herself left her house with her own sweet will.
6. Learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner.
7. Considering the aforesaid facts and circumstances of the case as well as the allegation against the petitioner, let the above named petitioner, in the event of her arrest/surrender within a period of six weeks from today, been enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Hilsa, (Nalanda) in connection with Hilsa P.S. Case No. 223 of 2023, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
8. The application stands allowed.
